Italy on Monday cited Austria to the
European Court of Justice over its restrictions on heavy goods
traffic at the Brenner Pass in the first such move by one EU
country against another. "It is a tough but obligatory choice in
light of the waiting game being played by the European
Commission and the impossibility of reaching a negotiated
solution," said Transport Minister Matteo Salvini.
"It will be up to the Court to clear up whether the Austrian
bans on heavy goods traffic are legitimate or whether the
principle of free circulation (of goods) should prevail.
Hitherto an EU member had never reported another one to the ECJ
for allegedly breaking Eu law.
